This case can be considered as an internet fraud.
Internet fraud refers to the use of internet services to present fraudulent
solicitations to prospective victims, to conduct fraudulent transactions, or to
transmit the proceeds of fraud to financial institutions or to others connected
in the scheme. Furthermore, a fraud is deliberate misrepresentation which
causes another person to suffer damages, usually monetary losses. At first, one
may not consider the case as an internet fraud basically because the children
bound for adoption really exists. Also, an internet service was available in
this case, A Caring Heart where the first couple had paid $6,000. The parties
involved in this case are the internet service which is the A Caring Heart, Mr.
and Mrs. Wecker, Mr. and Mrs. Allen, and Mr. and Mrs. Kilshaw. I think both the
Allens and the Kilshaws were innocent. It is for a fact that many couple
nowadays does not have children and so adoption becomes their option. And
because of technological advancements, the internet provides a venue for couples
to find children to be adopted, some couple even posts their profile and
contact details for it to be available and accessible for those who want their
children to be adopted. So, it can be
said that the Allens and the Kilshaws were both innocent and they were just on
the verge of having a children. Also, they were both innocent because it was
not verified if the internet placement service is authentic or real.
There are already international laws of adoption of
children. International adoption (also referred to as intercountry adoption or
transnational adoption) is a type of adoption in which an individual or couple
becomes the legal and permanent parents of a child that is a national of a
different country. In general, prospective adoptive parents must meet the legal
adoption requirements of their country of residence and those of the country
whose nationality the child holds (Wikipedia,2010). However, these laws vary
from country to country and parties must comply the requirements of each
country.
It is for a fact that the internet plays an
indispensable role in our daily life. Every aspect of our life is influenced by
the internet and its uses. Internet provides every individual the access to
almost all information available, be it on entertainment, jobs, travelling and
planning, etc. In this saga, the internet was the tool that paved way to the
double adoption of the twins. I think the internet placement service in this
case is a fraud. Firstly, transactions happened between the birth mother and
the adopting parents. Like the Kilshaws picking up the birth certificates from
Tranda Wecker. There was no third party involved like the management of the A
Caring Heart. What happens in this case is that the twins were illegally sold to
and bought by different parties with the use of the internet.
